Welcome to Kalawikk.com, a 100% Indigenous-led platform offering strategy, creative, and reconciliation-based services. By accessing or using this website and our services, you agree to the following Terms of Service ("Terms").

1. Acceptance of Terms

By using this site or engaging with Kalawikk’s services, you agree to comply with and be bound by these Terms, our Privacy Policy, and any other guidelines posted. If you do not agree, please do not use the site or our services.

2. Who We Work With

Kalawikk works with individuals, organizations, and communities who are committed to respectful engagement, equity, and ethical collaboration. We reserve the right to decline service if there is a misalignment with our values or community responsibilities.

3. Use of Our Website

You agree to use Kalawikk.com for lawful purposes only. You may not:

• Attempt to access data that you are not authorized to access

• Interfere with the website's functionality or security

• Reproduce, distribute, or modify any content without permission

4. Service Engagement Terms

When you engage Kalawikk for consulting, facilitation, creative, or other services:

• A clear scope of work and fee structure will be agreed upon in writing

• Project start dates may be confirmed upon receipt of a signed agreement and/or deposit

• You agree to timely communication, feedback, and payment

5. Payments and Refunds

• Invoices are payable upon receipt unless otherwise agreed

• Late payments may result in paused work or additional fees

• Deposits are non-refundable unless Kalawikk cancels the project prior to starting

• Refunds or credits may be considered on a case-by-case basis, rooted in reciprocity and fairness

6. Intellectual Property

Unless otherwise agreed:

• You retain ownership of your original content and materials

• Kalawikk retains ownership of frameworks, designs, tools, and processes created independently

• Shared cultural knowledge or stories will be handled with respect and in accordance with Indigenous protocols

7. Confidentiality

We treat all client information with confidentiality. You agree not to disclose Kalawikk’s proprietary processes or tools without written consent. We do not share personal or organizational details with third parties without your permission, except as required by law.

8. Cultural Protocol & Relational Ethics

As an Indigenous-led organization, we honour relationality, protocol, and community obligations. This may occasionally mean rescheduling due to ceremony, illness, or community care with clear communication.

We ask for the same respect in return. Harmful, discriminatory, or disrespectful behaviour will result in the immediate termination of services.

9. Limitation of Liability

Kalawikk is not liable for any indirect or consequential damages arising from the use of our website, services, or materials. All services are offered in good faith with professional diligence, but outcomes are not guaranteed.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be posted here, and continued use of the website or services constitutes acceptance of those changes.

11. Governing Law

These Terms shall be governed by the laws of the province of Newfoundland & Labrador, Canada, and where applicable, Indigenous legal traditions guiding our work.
